Asylum, Human Rights, Family and Private Life

There will be times when your circumstances are so compassionate and compelling that you will want to make a discretionary application outside the immigration rules. This means that although you do not meet the legal criteria for a visa it may be that there are strong reasons which justify the grant of a visa. For example where your circumstances engage Article 8 (right to a private and family life) of the European Convention of Human Rights.

If you are in the UK illegally, facing removal, deportation or have lived in the UK for a considerable length of time then you may apply for leave to remain in the UK on the basis of your family and private life under Article 8 of the European Convention on Human Rights. Article 8 addresses the issues of those persons who may have built up close ties to the UK. It will cover all circumstances involving spouses, unmarried partners, children and cases where there are clearly compassionate and compelling family reasons to allow a person to remain in the UK.

Seven Year Child Policy

Cases involving children always require the upmost consideration and recent changes in legislation now means that children who have lived in the UK for a continuous period of seven years have a stronger right to remain here. Parents of British Citizen or settled children may also have the right to remain in the UK on the basis of access rights to their children and/or as having joint or sole responsibility of those children. These cases are sensitive in nature and require further discussion in person so that we are able to assess the full circumstances of your case and advise you on the chances of success.
